What is the Brazilian Golden Visa?


The so-called Brazilian “Golden Visa” is a residence permit granted to foreigners who make significant investments in the country. Regulated by Normative Resolution No. 36/2018 of the National Immigration Council (CNIg), this visa allows the investor to live legally in Brazil, with the possibility of extending the residency to their legal dependents.


The legal basis is based on article 1 of Normative Resolution No. 36/2018 of the Ministry of Justice:


“Art. 1º A temporary visa may be granted to immigrants who intend to come to Brazil for the purpose of making a significant investment in urban real estate”.


This type of visa is part of a policy to encourage the entry of foreign capital into the country, promoting economic development, especially in the areas of housing and infrastructure.


Investment in Real Estate: How It Works


Normative Resolution No. 36/2018 establishes that foreign investors may obtain residency in Brazil if they make a minimum investment of R$1,000,000.00 (one million reais) in urban real estate, built or under construction, located in urban areas of the country.


However, in the states of the North and Northeast, such as Piauí, where real estate appreciation has grown significantly, the minimum investment value may be reduced to R$700,000.00 (seven hundred thousand reais), according to §2 of article 2 of the same regulation:


“§2º The investment value may be reduced to R$700,000.00 (seven hundred thousand reais) in real estate located in the North and Northeast regions of Brazil”.


This investment must be made with the foreigner's own resources, proven by means of financial documents and official records of capital entry into the country, according to the rules of the Central Bank of Brazil and the Federal Revenue Service.


Documentation and Procedures


The process requires the presentation of documentation that proves:


- Ownership of the property in the name of the foreigner;

- The value of the investment;

- The regularity of the property with public agencies;

- Registration of the purchase and sale agreement at the Real Estate Registry Office;

- The lawful origin of the resources.


After the documentation has been analyzed by the consular authority or by the General Coordination of Labor Immigration (CGIL), the foreigner may receive a temporary visa for up to two years, renewable, and later convert it to permanent residence, in accordance with Decree No. 9,199/2017, which regulates the Migration Law (Law No. 13,445/2017).
